2. Area of application, definitions
2.1 The following general terms and conditions apply to all contracts with us entered into by a consumer or merchant about the products offered in our online shop.

2.2 A consumer is any natural person who enters a business contract for some purpose which is not related to their business activity. A merchant is any natural person or legal entity which acts in exercise of their trade, business or profession when entering the contract.

3. Conclusion of Contract
3.1 Our product display in our online shop represents a binding offer to order goods from us.

3.2 You accept our offer of contract about the products in your shopping basket by clicking the field “Place order now“ at the end of your order process. The purchase agreement comes into effect with this order confirmation.

3.3 Upon receipt of your order you receive an order confirmation from us via email.

4. Prices, delivery charges
4.1 All prices listed in our online shop are complete and final. The complete and final price comprises of all price parts, including the relevant legal turnover tax. Further duties and fees might apply to deliveries into non-EU countries. Further information is available here:

4.2 Charges for packaging and delivery are separate

Charges for delivery within the UK:
For orders above £50.00, we will charge a flat shipping rate of £5.00 for postage and packing.
For orders below £50.00 we charge £10.00.

For other countries, the following applies:
Ireland for orders over £50.00 GBP: £10.00
Others within the EU (any order value): £10.00

Deliveries to Norway (any order value): £15.00
Delivery charges to USA (any order value): £40.00

Customs, taxes, and charges are not included in the item price or shipping cost. These charges are the buyer's responsibility. When the order shall be delivered to Great Britain or any other non-EU country, you agree to pay any applicable customs, duties, or taxes levied by your destination country.

5. Payment

Credit card

We accept the following credit cards: VISA, MasterCard. The credit card company will be authorised to debit your credit card account with the invoiced amount immediately after the conclusion of the contract. The transaction will appear as „Schuhhandelsgesellschaft Ruhr mbH“ in your statement.

 

 

Payment via PayPal

If you choose the payment method PayPal the payment will be processed by the payment service 
provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg in 
accordance with the current PayPal terms of use.
Paypal accepts the following credit cards: Visa, Mastercard, American Express, Discover, UnionPay. With this type of payment you will not incur any additional costs. A possible exception would be exchange rate fees if the payment is made in a currency other than EUR or if your credit card company charges additional fees.
If you choose the payment method "PayPal payment by instalments" we assign our payment claim to PayPal. Before accepting the declaration of assignment PayPal carries out a credit check using the transmitted customer data. We reserve the right to refuse the payment method "PayPal payment by instalments" in the event of a negative test result. If “payment by instalments” is accepted by PayPal you can pay the invoice amount to PayPal at the specified conditions that are communicated to you during the ordering process. In this case you can only pay to PayPal with a debt-discharging effect. However, even in the case of the assignment of claim, we remain responsible for general customer inquiries, e.g. regarding goods, delivery time, shipping, returns, complaints, declarations of revocation or credit notes.

Payment via Amazon Pay

With Amazon Pay you can conveniently pay with your payment and address information saved on Amazon. To pay with Amazon Pay you need an Amazon account. If you do not have an Amazon account a corresponding account can be created during the order process.For the payment process please click on the yellow button "Pay with Amazon Pay". After successfully logging in to Amazon Pay you have the option of adjusting your payment and address information and completing the order. The payment process with Amazon Pay is quick, easy and secure. You do not need a guest or customer account with us. The payment process runs entirely through Amazon Pay. You do not have to enter any address or payment data and no sensitive data is transmitted to us. By purchasing via Amazon Pay you will not incur any additional costs.




Payment via Apple Pay

With Apple Pay you can make purchases in our online shop particularly quickly and easily because you do not have to fill out any forms or create a customer account when shopping with your Apple device. After you have saved your account information once via the wallet app simply select Apple Pay as the payment method in the order process. You can connect Apple Pay to your credit or debit card and then confirm the payment via Face ID or Touch ID.



Redemption of promotional coupons (vouchers)

As part of advertising measures, we issue promotional coupons with a predetermined period of validity. Our promotional coupons can only be redeemed within the specified period and only once as part of an order process. We reserve the right to combine the option of redeeming promotional coupons with a minimum order value. The value of the order must at least be equal to the amount of the promotional coupon. A difference to a higher value of the goods can be compensated with the payment options we offer. The value of a promotional coupon cannot be redeemed in cash and will also not be reimbursed if the goods ordered are fully or partially returned. Promotional coupons can only be redeemed before completing an order process. Subsequent crediting is unfortunately not possible. The promotional coupon cannot be transferred to third parties. Several promotional coupons cannot be combined with one another unless we have agreed otherwise. If you have redeemed a promotional coupon and are returning goods within the statutory right of withdrawal we reserve the right to charge you the original price for the goods that you have not returned. This only applies if the value of the order, after deducting the returned goods, falls below or corresponds to the respective value of the promotional coupon / minimum order value.


6. Area of delivery and delivery time
6.1 Within the EU there are no delivery restrictions. If you choose the payment method PayPal, delivery can only be made to the address registered with your PayPal account.

6.2 Delivery within The UK is 3 to 6 days (except Northern Ireland). Deliveries within the EU and (non) European countries and the USA will take up to 10 working days (2 weeks).


7. Reservation of ownership 

The goods supplied by us remain our property subject to receipt of payment in full.

8. Statutory right of cancellation

The statutory right of cancellation applies exclusively to consumers within the EU member states. For the definition of consumer please refer to article 2.2 of these terms and conditions.

Cancellation of deliveries within the UK / EU 
Please contact our sales department via info@ara-shoes.co.uk or call 0800 0 966377 (free of charge within the UK). Your statutory right of cancellation will not be affected even if you do not contact us prior to returning your order to us.


9. Legal liability in case of defects
You are covered by our legal liability in case of defects for products purchased from us. 

10. Applicable law, court of jurisdiction

10.1 The law of the Federal Republic of Germany shall exclusively govern the performance of all contracts excluding the UN-Convention on Contract for the International Sale of Goods (CISG). 
For any consumer, this choice of law applies only to the extent that the protection granted by the mandatory provisions of the law of the country of the consumer's usual residence is not restricted.

In commercial transactions with merchants and legal persons under public law, the court of jurisdiction for all disputes arising from or in connection with the contract shall be the court responsible for the place of business of ara online shop. The same applies even if a merchant does not have a general place of jurisdiction in Germany or their place of residence and/or usual address is not known at the time when a lawsuit is filed. We reserve, however, the right to appeal to another court of jurisdiction.

11. Dispute Resolution
We are neither willing nor obliged to take part in a dispute resolution process in front of a consumer dispute resolution agency.

B. Customer Information

1. Individual, technical steps leading to the conclusion of a contract

The order process in our online shop is activated by mouse click via labelled and self-explanatory buttons. In order to enter a binding contract you will have to undergo the following technical steps:

- Place a product in your basket
- Sign up for a customer account (user name / password), register as a new customer, enter your personal data or order as a guest
- Choose a payment method
- Tick the boxes of ‘Terms and Conditions’, and order cancellation information
- Review the summary of all order details
- Place your contract declaration which leads to the conclusion of the contract

2. Saving and accessibility of the contract text after conclusion of the contract

We save the contract text. You can access the contract text (such as product description, terms and conditions and customer information) during the order process and print and archive it via the print function in your internet browser. Immediately upon receipt of your order we will send you an email with a confirmation of the details of your order and the contract which you can print and save. After the conclusion of the contract you will no longer be able to access the contract information in our online shop. If you have registered a customer account, all your orders are saved in “My account / my orders”.

3. Visibility of and changes to input errors during the order process

You can recognize input errors during the order process at any time as your input is save immediately and visible on screen. In case of input errors, please use the labelled and self-explanatory buttons which we provide during the order process for changes and corrections. On the final order page you can check and change all order details prior to concluding the contract.

4. Languages available to conclude the contract
Contracts in our online shop are exclusively concluded in the English language.
